This Privacy Policy explains how Fund Your Business LLC ("Pen & Porch," "we," "us") collects, uses and protects information when you visit penandporch.com, request a sample, or use our handwritten note service (the "Service"). We are based in Minnesota, USA.

1. Information we collect

From you (our customers and visitors)

• Contact details: name, business name, email, phone number and mailing address, for example when you request a sample or start a trial.
• Account and billing details: your plan, order history and billing address. Payments are processed by our payment processor. We do not store full credit card numbers.
• Content you give us: message text, logos, artwork, photos, and handwriting or signature samples used to create your cards.
• Communications: emails, texts and calls with us.
• Website data: device and browser type, pages viewed, and similar information collected automatically through cookies and analytics tools.

About the people you send cards to ("recipients")

To send notes for you, we receive recipient information you upload or share, such as names, mailing addresses, and dates like birthdays or purchase anniversaries. For this information we act on your behalf, as your service provider. You are responsible for making sure you have the right to share it with us for this purpose.

2. How we use information

• To write, address and mail the cards you order, and to confirm when they go out.
• To run scheduled programs you choose, such as birthday, anniversary and holiday notes.
• To mail you a free sample card and follow up about it.
• To bill you, provide customer support, and send service messages.
• To send marketing emails or texts, but only where permitted, and you can opt out anytime.
• To keep our site and Service secure, prevent fraud, and improve our Service.
• To comply with the law.

We never use recipient information for our own marketing, and we never contact your recipients except by mailing the cards you order.

3. How we share information

We do not sell personal information. We share it only with:

• Fulfillment partners who write, print and mail cards for us, only as needed to produce your order.
• The U.S. Postal Service, which delivers the cards.
• Service providers who help us run the business, such as website hosting, CRM, email and text messaging, and payment processing. They may use the information only to provide services to us.
• Legal and safety reasons: if required by law, or to protect our rights, our customers or others.
• Business transfers: if our business is sold or merged, information may transfer to the new owner under this policy.

4. Text messages (SMS)

If you give us your mobile number and agree to receive texts, we may text you about your sample, orders and account. We send marketing texts only if you separately agree to receive them. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. Agreeing to receive texts is not a condition of purchase. We do not share your mobile number or text-message consent with third parties or affiliates for their marketing purposes.

5. Cookies and analytics

Our website uses cookies and similar tools to remember your preferences, understand how visitors use the site, and measure our advertising. You can block or delete cookies in your browser settings. Some parts of the site may not work properly without them. Our site does not currently respond to "Do Not Track" browser signals.

6. How long we keep information

• Recipient lists: kept while your account is active so we can run your card programs, and deleted within 90 days after your account closes or sooner at your request, unless the law requires us to keep them.
• Customer and billing records: kept as long as needed for accounting, tax and legal purposes.
• Sample requests: kept until you ask us to delete them or they are no longer needed.

7. How we protect information

We use reasonable administrative, technical and physical safeguards, such as access controls and encrypted connections, to protect information. No method of storage or transmission is completely secure, but we work hard to protect your data.

8. Your privacy rights

Wherever you live, you may ask us to:

• Confirm whether we have your personal information and give you a copy of it
• Correct information that is wrong
• Delete your information
• Stop sending you marketing messages

Minnesota residents: the Minnesota Consumer Data Privacy Act gives consumers rights over their personal data, including the rights to access, correct, delete and port it, and to opt out of targeted advertising, the sale of their data, and certain profiling. We honor these requests as described above. We do not sell personal data or use it for profiling that produces legal or similarly significant effects.

Card recipients: if you received a card from us and don't want to receive more, email us your name and mailing address. We'll add you to our do-not-mail list and let the business that sent the card know.

To make a request, email [email protected]. We may need to verify your identity, and we will respond within 45 days. If we deny your request, you may appeal by replying to our decision, and we will respond to your appeal within 45 days.

9. Children

Our Service is for businesses and adults. It is not directed to children under 18, and we do not knowingly collect information from children.

10. Changes to this policy

We may update this policy from time to time. We'll post the new version on this page with a new effective date. If the changes are significant, we'll notify customers by email.
